Terms of Use
Last updated: 15 April 2026
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. THEY INCLUDE A BINDING INDIVIDUAL ARBITRATION AND CLASS-ACTION WAIVER (SECTION 13). IF YOU DO NOT AGREE, PLEASE DO NOT USE THE WEBSITE.
1. About these terms
These Terms of Use are a legal agreement between you and Quantum Men's Health US, Inc., a Delaware corporation with its principal office at 251 Little Falls Drive, Wilmington, DE 19808, doing business as Quantum Men's Health ("Company", "we", "our", "us"), governing your use of www.quantummenshealth.com and any connected patient app (together, the "Site").
Clinical services are provided by independently licensed US physicians and pharmacies and, where applicable, through professional corporations affiliated with us. Quantum Men's Health does not itself practice medicine or dispense medication.
By using this Site you agree to be bound by these Terms, our Privacy Policy, our Notice of Privacy Practices, our Cookie Policy and any additional terms that apply to specific services.
2. Eligibility
The Site and our services are available to users who are 18 years of age or older and physically located in a US state in which our affiliated clinicians are licensed to provide care. By using the Site you represent that you meet these eligibility requirements and that the information you provide is accurate and complete.
3. Changes to these terms
We may revise these Terms from time to time at our sole discretion. Changes are effective when posted. Your continued use of the Site constitutes acceptance.
4. Nature of our service and medical disclaimer
Quantum Men's Health provides an AI-assisted, doctor-led telehealth platform through which you can request a consultation, receive laboratory testing, be prescribed regulated medications (including testosterone replacement therapy) and have medications dispensed through licensed pharmacy partners.
Information published on the Site is provided for general informational purposes only and is not medical advice, does not create a physician–patient relationship with Quantum Men's Health itself, and is not a substitute for professional medical advice, diagnosis or treatment. A physician–patient relationship is formed only when you complete an evaluation with an affiliated, licensed clinician and that clinician accepts you into care.
ADAM, our AI-assisted assessment tool, supports — but does not replace — clinical decision-making by a licensed clinician. No prescription is issued on the basis of an AI assessment alone.
In a medical emergency, call 911 or go to your nearest emergency department. The Site is not intended for emergencies.
5. Consultations, prescribing and dispensing
- Care is provided by clinicians licensed in your state and pharmacies licensed by the applicable state board of pharmacy. Prescriptions for testosterone and other DEA Schedule III–controlled substances are issued in compliance with federal law (including the Controlled Substances Act and, where applicable, the Ryan Haight Online Pharmacy Consumer Protection Act) and applicable state law.
- A prescription will only be issued where, following review, a licensed clinician determines that the treatment is clinically appropriate, safe and lawful.
- We may decline to offer a consultation, issue a prescription or continue care at our clinical discretion.
- Medications are dispensed and supplied by our licensed pharmacy partner(s). Your contract for dispensed medication is with that pharmacy.
- You must provide accurate, complete and current information during any consultation. Providing false or misleading information may result in immediate termination of care.
- Suspected adverse events should be reported to us promptly; we and our clinicians may report serious adverse events to the FDA through MedWatch.
6. Purchases, payment and subscriptions
- The Site may offer products, services, subscriptions and treatment packages for sale. You agree to be financially responsible for all purchases made through your account.
- Prices are shown in US Dollars and are exclusive of applicable state sales tax unless stated otherwise.
- Payment is processed by our PCI-DSS compliant payment processor (Stripe). We do not store full payment-card numbers.
- Subscriptions auto-renew on the cadence shown at checkout and will continue to renew until cancelled. You can cancel at any time via your account or by contacting customer support. Our full Refund & Cancellation Policy is available separately on the Site. Prescription medications and personalised compounded products are generally non-returnable for safety reasons.
7. Acceptable use
The Site may only be used for lawful purposes. You must not:
- impersonate any person or misrepresent your identity;
- use the Site in a manner that damages, disables or impairs it or interferes with other users;
- use automated means (bots, scrapers, crawlers) without our prior written consent;
- attempt to gain unauthorised access to any account, system or network;
- upload or transmit any material that is defamatory, obscene, infringing, harassing or otherwise unlawful;
- resell or redistribute any medication or laboratory kit supplied through the Site.
We may suspend or terminate your right to use the Site at any time, including where we reasonably suspect a breach of these Terms.
8. Intellectual property
The content and design of the Site, and any products and services sold through it, are the sole and exclusive property of the Company and its licensors. All trademarks, service marks, logos and trade names displayed on the Site are the property of their respective owners. You may not reproduce, copy, display, distribute, republish or otherwise use for any commercial purpose any such content without our prior written permission, nor remove any proprietary notice. Any code on the Site is protected by copyright and you may not use or copy such code.
9. Third-party links
The Site may include links to third-party sites. We have no control over those sites, which have separate privacy and data-collection practices. You access them at your own risk.
10. Disclaimer of warranties
EXCEPT AS REQUIRED BY LAW, THE SITE AND ANY PRODUCTS OR SERVICES SOLD THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. We do not warrant that access will be continuous, uninterrupted, bug-free, error-free or free of viruses or other destructive code, or that information will be accurate or complete.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS OR THE SITE WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
12. Indemnification
You agree to defend, indemnify and hold harmless the Company and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
13. Dispute resolution — binding individual arbitration; class-action waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim or controversy arising out of or relating to these Terms or the Site (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. The seat of arbitration will be Wilmington, Delaware.
Class-action waiver: You and the Company each agree that any Dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding.
You may opt out of this arbitration agreement by sending written notice to the address in section 15 within 30 days of first accepting these Terms. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to protect intellectual-property rights, or from reporting a complaint to a state or federal regulator.
14. Governing law
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law principles, and (subject to section 13) by the Federal Arbitration Act with respect to arbitration.
15. Contact
If you have any questions about these Terms, please contact us at legal@quantummenshealth.com or at Quantum Men's Health US, Inc., 251 Little Falls Drive, Wilmington, DE 19808.
